The Federation of Independent Retailers (The Fed) has sounded the alarm: small stores are already struggling to survive, and without proper enforcement, they face even greater pressure. Rogue sellers continue to flood the market with illicit vapes and unregulated nicotine pouches, while legitimate businesses are left to compete on an uneven playing field.
No Enforcement = No Deterrent
Despite new legislation, many retailers fear it will become yet another “paper policy”—well intentioned but toothless. Without real-time penalties, market surveillance, and retailer inspections, illegal sellers will continue to undermine both the law and the legitimate supply chain.
Illicit products don’t just harm consumers—they undercut compliant retailers who invest in legal stock, pay taxes, and follow the rules. As one retailer put it, “We’re being punished for doing the right thing.”
The Retailer’s Ask: A Level Playing Field
Retailers are calling for a clear, enforceable framework that includes:
- Consistent enforcement across all retail channels.
- Tougher penalties for those caught selling illicit or unregulated products.
- Support for retailers who report suspicious activity.
- Clear guidelines on packaging, labeling, and sale limits.

We urge UK authorities to match policy with resources and empower trading standards teams with the funding, tools, and clarity they need to act decisively.
