Spain is quickly becoming a focal point in the broader European debate over nicotine pouches. While EU institutions weigh broader harm reduction strategies, Spain has taken a more cautious—and in some cases, restrictive—approach to regulating these alternatives.
GINN recently held a regional engagement in Spain to better understand the local regulatory landscape, meet with policymakers and industry stakeholders, and share evidence around science-based harm reduction.
At the center of the tension lies a policy gap: nicotine pouches are not yet fully regulated under Spanish law, creating uncertainty for both manufacturers and retailers. Meanwhile, proposed restrictions—ranging from flavor bans to outright prohibition—have stirred public health debate, with many calling for a clearer and more proportionate framework.
As detailed in our Spanish-language insight article, “Industria, Regulación y Realidad: La Perspectiva Española sobre las Bolsas de Nicotina,” GINN has urged lawmakers to avoid reactionary policies and instead embrace an approach grounded in science, risk differentiation, and consumer protection.
Our visit emphasized the need to:
- Engage with Spanish regulators on evidence-based solutions
- Highlight the role of pouches in supporting adult smokers
- Counter misinformation about nicotine and youth use
With Spain’s position likely to influence other EU Member States, GINN will continue to monitor developments closely and advocate for policies that protect public health without shutting down safer alternatives.
